Terms of Use

These Terms of Use ("Terms") govern your use of the TRecs mobile app (the "App"), operated by Flashpacking Inc. ("Flashpacking," "we," "us"). Please read them. If you have questions, contact us at admin@flashpackingguide.com.

1. Agreeing to these Terms

By creating an account, you agree to these Terms and to our Privacy Policy. If you don't agree, don't create an account or use the App.

We may update these Terms from time to time. When we do, we'll revise the effective date at the top of this page. If you keep using the App after an update, you accept the updated Terms.

2. Who can use the App

You must be 18 or older to use the App. By creating an account, you confirm that you are.

You may have one account. Keep your password secure — you're responsible for what happens under your account. If you believe someone else has accessed it, reset your password from the Account screen and let us know.

3. Your content

The recs, ratings, notes, and routes you create in the App are yours. You keep ownership of them.

To run the App, we need your permission to store your content and to deliver it to the people you choose to send it to. By using the App, you give Flashpacking a limited, non-exclusive, royalty-free permission to store, copy, and transmit your content for that purpose only. We don't sell your content or use it for advertising.

When you send a rec or route to another user, a copy — including your username and any notes you included — becomes part of their account. Deleting your own content or your account doesn't remove copies you've already sent.

You're responsible for what you send. Only send content you have the right to share.

4. What's not allowed

You may not use the App to create or send content that:

  • harasses, threatens, bullies, or intimidates anyone;

  • promotes hatred or violence against people based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or age, including slurs;

  • is sexually explicit;

  • is illegal, or promotes or facilitates illegal activity;

  • impersonates another person or misrepresents who you are;

  • is spam, or is sent in bulk or to people who haven't asked for it; or

  • infringes anyone's copyright, trademark, privacy, or other rights.

You also may not attempt to access other users' accounts or data, interfere with the App's operation, or use the App in a way that violates any law.

5. Reporting and enforcement

Every rec and route another user sends you includes a way to report it. Reporting also blocks the sender, so they can't send you anything further, and removes what they sent you that's still waiting in From Friends. You can manage the people you've blocked from the Account screen.

We review reports. If we find that content or an account violates these Terms, we may remove content, and suspend or terminate the account, at our discretion and without prior notice.

6. The App is provided as-is

We work to keep the App accurate and running, but we can't guarantee it. Venue details, opening hours, ratings, recommendations, and generated itineraries may be incomplete, out of date, or wrong. Check important details — like whether a place is open — before you go. Recommendations from other users are their opinions, not ours.

The App is provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows. We may change, suspend, or discontinue any part of the App at any time.

7. Limitation of liability

To the fullest extent the law allows, Flashpacking will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the App. Our total liability for any claim relating to the App is limited to one hundred US dollars (US$100).

Some places don't allow certain limitations of liability, so some of the above may not apply to you.

8. Ending your account

You can delete your account at any time from the Account screen. We describe what deletion removes, and what it doesn't, in our Privacy Policy.

We may suspend or terminate your account if you violate these Terms. Sections 3 (as to copies already sent), 6, 7, and 9 continue to apply after your account ends.

9. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the App will be brought in the state or federal courts located in Travis County, Texas.
